Article 1 - Definitions
In these terms and conditions, the following definitions shall apply:
- Reflection period: the period within which the consumer can exercise his right of withdrawal;
- Consumer: the natural person not acting in the exercise of a profession or business who enters into a distance contract with the entrepreneur;
- Bye: calendar day;
- Duration transaction: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time;
- Durable data medium: any means that enables the consumer or trader to store information addressed personally to him in a way that allows future consultation and unaltered reproduction of the stored information;
- Right of withdrawal: the possibility for the consumer to waive the distance contract within the cooling-off period;
- Entrepreneur: the natural or legal person offering products and/or services to consumers at a distance;
- Remote agreement: an agreement under which, within the framework of a system organised by the entrepreneur for distance selling of products and/or services, up to and including the conclusion of the agreement, exclusive use is made of one or more techniques for distance communication;
- Remote communication technology: means that can be used to conclude an agreement, without the consumer and entrepreneur having come together in the same room at the same time;

- the professional association or organisation to which he is affiliated;
- the professional title, the place in the EU or the European Economic Area where it was awarded;
- a reference to the professional rules applicable in Belgium and indications of where and how these professional rules can be accessed.
Article 3 - Applicability
These general terms and conditions apply to every offer made by the trader and to every distance contract concluded between the trader and consumers. The General Terms and Conditions can be found on the website www.pelletkachelvoordeel.be. If this is not possible, the terms and conditions can be sent free of charge at the consumer's request.
Article 4 - The offer
The offer contains a complete and accurate description of the products and/or services offered. Images are a true representation of the products and/or services on offer. Obvious mistakes or errors do not bind the entrepreneur.
Each offer contains such information that it is clear to the consumer what rights and obligations are attached to the acceptance of the offer, including:
- prices including taxes;
- any costs of delivery;
- method of formation of the agreement;
- applicability of the right of withdrawal;
- payment, delivery and performance conditions;
- period for acceptance of the offer;
- other relevant information.
Article 5 - The agreement
The agreement is concluded at the moment the consumer accepts the offer and fulfils the conditions stipulated thereby. In case of electronic acceptance, the trader will immediately confirm receipt of the acceptance electronically. The entrepreneur may, within legal frameworks, check whether the consumer can meet his payment obligations and may refuse an order, giving reasons.
The entrepreneur provides the following information when providing products/services:
- visiting address of the entrepreneur for complaints;
- conditions and method of withdrawal;
- information on guarantees;
- data as mentioned in Article 4;
- conditions for termination of long-term contracts.
In the case of a duration transaction, these provisions only apply to the first delivery.
Article 6 - Right of withdrawal
Products: When purchasing products, consumers have the right to dissolve the contract without giving reasons for 48 hours from the day after receiving the product, provided the product has not been used/opened, and is returned in its original condition and packaging.
Services: When supplying services, the consumer has the option of dissolving the agreement without giving reasons for 14 days after entering into the agreement. Use of the right of withdrawal can be made in accordance with the entrepreneur's instructions.
Article 7 - Costs in case of withdrawal
If the right of withdrawal is exercised, the return costs shall be borne by the consumer. Amounts already paid will be refunded within 30 days of receipt of the return or cancellation at the latest.
Article 8 - Exclusion of the right of withdrawal
All pellet stoves and specially ordered products may not be returned (custom-made/made-to-order products). For other products, the right of withdrawal only applies if not custom-made.
Article 9 - The price
During the period of validity of the offer, prices will not be increased except as a result of changes in VAT rates. Price increases within three months of the agreement are only allowed if they result from legal regulations.
All prices include VAT.
Article 10 - Conformity and Warranty
The entrepreneur guarantees that the products and/or services comply with the agreement, the stated specifications, reasonable requirements of soundness and applicable legal regulations. Any manufacturer's warranty does not affect the legal rights of the consumer.
Article 11 - Delivery and execution
The entrepreneur delivers orders with the utmost care. The place of delivery is the address provided by the consumer. Orders are normally delivered within 100 days at the latest, unless otherwise agreed. If there is a delay, you will be informed within 30 days; you then have the right to dissolve the agreement without costs and receive a refund.
The risk of damage or loss until delivery rests with the entrepreneur.
Article 12 - Duration transactions: duration, termination and renewal
For open-ended contracts, the consumer may terminate at any time subject to a notice period of up to one month.
A fixed-term contract is not tacitly renewed, unless permitted by law.
Article 13 - Payment
Unless otherwise agreed, the consumer pays in advance by bank transfer, bancontact or other online payment methods. Inaccuracies in payment details should be reported without delay. In case of late payment, the entrepreneur is entitled to charge reasonable costs.
Article 14 - Complaints procedure
Complaints must be submitted to the entrepreneur within a reasonable time, fully and clearly described. Complaints will be dealt with within 30 days at the latest.
Article 15 - Additional or different provisions
Additional provisions or provisions deviating from these general terms and conditions may not be to the detriment of the consumer. They must be recorded in writing or in such a way that the consumer can store them in an accessible manner on a durable data carrier.

Article 16 - Validity of General Terms and Conditions outside the Webshop If you make a purchase outside the web shop, such as in a physical showroom, the separate shop terms and conditions apply in addition.
Article 17 - Costs for installers Pelletkachelvoordeel.be carefully delivers its products, but is not responsible for installation work, nor for costs incurred by the installer due to delivery problems or returns. Pelletkachelvoordeel.be delivers no installation service and does not carry out installation work.
Article 18 - Reporting damage and defects Any damage or inaccuracies to delivered products must be reported within 48 hours of receipt via [email protected]. After this, a report can be processed in accordance with the service procedure.
Article 19 – Returning heaters/pellet stoves All pellet stoves are specially ordered and therefore cannot be returned. Other specially ordered products are also outside the consumer's right of withdrawal.
Article 20 - Warranty All products sold by pelletkacheldeel.be carry the manufacturer's warranty as per brand and product. In addition, the legal rights concerning guarantee and conformity apply without prejudice.
Article 21 - Order items Products that are not in stock may have a longer delivery time. For these so-called order items, processing of the order does not start until payment is received.
Article 22 - Default If you do not pay or do not pay in full after repeated requests, the amount due will be increased by extrajudicial collection costs according to the statutory rate. You will also owe interest of 2% per three weeks (with a minimum of €35 per three weeks). All unpaid bills will then become immediately due and payable.
Article 23 - Delivery Pelletkachelvoordeel.be uses external logistics partners. Delivery takes place up to the first threshold of the ground floor. If you require further assistance than is offered as standard, this is only on request at your own risk and responsibility.
Final provisions
Applicable law and disputes On all agreements and these general conditions, only the Belgian law is applicable. Disputes between the consumer and Pelletkacheldeel.be are, if not by mutual agreement, submitted to the competent judge in the region where the entrepreneur is established.
